FEADLE REFUSES TO INVESTIGATE THE GOVERNOR AND THE STATE FIRST ATTORNEY, BUT FEDERAL JUDGE REVOKES ITS DETERMINATION.

A federal judge from the penal accusatory system revoked FEADLE's determination to abstain from prosecuting governor Quintana Roo's Governor, Carlos Joaquín González as well as the state First Attorney, Óscar Montes de Oca Rosales, who were denounced by journalist Fabiola Cortés Miranda for offenses against the freedom of speech.

Last October 13th there was an audience in which the journalist exposed her arguments against the "abstention to investigate" dictated by the Specialized Agency for the Attention of Offenses Against the Freedom of Speech (FEADLE in Spanish) on march 8th, after Cortés Miranda presented a denounce against the public officers.

The denounce was presented to the FEADLE on February 22nd, 2021, in which the journalist detailed how starting on December 2020, the date when she unveiled a dispossession disguised as a buy-sell operation performed by the Quintana Roo Governor's brother in law, José María Rejón de la Guerra, started a mediatic campaign of discredit and insult against the work of Cortés Miranda, in her carachter of journalist, activist and lawyer; besides, since January 2021 she has been involved into three investigative ledgers pointing her as if being accomplice of offenses related to dispossessions.

Amongst the proof included in the denounce, Fabiola Cortés Miranda provided video evidence of the State First Attorney Óscar Montes de Oca Rosales at the Justice Commission of the XVI Legislature in which he made several accusations against the journalist, even accusing her of dispossessing a "really humble Mahahual community". Besides, there were dozens of links and screenshots of published articles that repeat the same discourse from the State First Attorney.

In said impugnation audience, Fabiola Cortés Miranda pointed out that starting on December 2020, after she unveiled the case in which the state governor brother in law is involved, after this an intense campaign was displayed in media outlets and social networks in which several fake articles were displayed and that sum hundreds of articles; said notes reproduce the discursive line poured by the State First Attorney Óscar Montes de Oca Rosales in both of his declarations.

The determination to "abstain to investigate" by the FEADLE vulnerates the most elementary right of access to justice of the denouncing part since without any tramit and without performing any investigative action decided not to start the prosecution; nonetheless, in the audience of last October 13th, a judge revoked this determination and ordered to the FEADLE to dictate a new resolution considering the carachter of journalist of the accusing part and how her activity would be affected by the denounced actions by virtue of she having to cover exceptional resources into her defense, which can represent an barrier and obstruction to freedom of speech.
